If you have been served with a foreclosure summons and complaint on your residence, Mr. Marks can strategize a legal defense to buy you time to stay in your home.

The foreclosure defense, which first involves the filing of a Verified Answer to the foreclosure complaint, can allow you a great deal of flexibility and time to pursue a range of further options. These options may include:

  1. A loan modification on your existing mortgage;
  2. A forbearance agreement, which adds missed mortgage payments onto the end of your loan;
  3. A short sale, if you decide to sell the house;
  4. A Chapter 7 or Chapter 13 bankruptcy filing (I can refer you to a reputable attorney for this);
  5. Technical defenses based on the discovery of defects in your loan, such as statute of limitations, breach of contract, or improper endorsements of assignments, which can sometimes void the entire mortgage.
